Emergency Injunctions in Family Court
There are some occasions when a relationship breaks down when there is a need to offer protection to one party. This can be done by seeking protective measures from the Court in the form of a Non Molestation Order and Occupation Order.
Non Molestation Order
This is an order preventing a person from using or threatening violence against the other or from intimidating, harassing or pestering them or their children.
Occupation Order
An order capable of forcing someone to leave a property, usually the former family home. It can also exclude someone from part of the home or a geographical location.
These types of applications are generally made to the Court on an emergency basis.
