Probate Sales

Executors appointed by the deceased’s Will are personally responsible for the proper administration of the estate: liabilities must be paid, assets gathered in and beneficiaries’ legacies satisfied.

 

All finances, assets and property in an estate, including the deceased’s former home will remain ‘frozen’ until the Probate Registry gives the authority (via a ‘grant of representation’) to the individuals nominated in your Will or if you have no Will, to the appropriate family member, to act.

 

We can advise you as a Personal Representative of the Deceased on obtaining a formal valuation. In appropriate cases, we can arrange for a full probate and house clearance service. Probate value will not only establish the amount of Inheritance Tax payable on the estate, but will also give the base value for any Capital Gains Tax on a future sale.

Acting for buyers, we will carefully vet any Special Conditions of Sale and the Title which can contain hidden conditions e.g. a buyer’s premium. For buyers, we also work closely with Mortgage Brokers and Lenders to ensure that all the finances are in place prior to the auction date.
