If you are unfortunate enough to return from your holiday with injuries after having had an accident or sickness, what can you do?
The Package Travel, Package Holidays and Package Tours Regulations 1992 allow holidaymakers to sue the tour operator if they have booked two components of their holiday with them (transport, accommodation or other tourist services).
Make sure that the accident is reported to the hotel/holiday company, photographs obtained, details of medical treatment received and of any witnesses who saw the accident.
The standard for any hotel premises is judged by their local standards and therefore this may be lower than we would expect in the UK.
A good example is a recent case, which we successfully concluded against TUI UK Limited. Our client slipped on juice on the floor of the buffet restaurant after a waiter carried out a tray of food. She received compensation for her injury, her ruined holiday and medical expenses.
