At the beginning of January 2019, the Human Fertilisation and Embryology Act 2009 (Remedial) Order 2018 was granted, enabling single parents who rely on the use of a surrogate to apply for a parental order to become the child’s legal parent.
This would also enable them to obtain a birth certificate which would name them as the child’s parent, allow the child to be recognised as a British citizen, as well as ensuring that the parent was entitled to “surrogacy leave” with their place of employment.
Previously, only couples using a surrogate were able to apply for a parental order. This however was subject to criticism because it clearly discriminated against single parent families. The lack of legal protection for single parent families needed to be addressed, and as such challenges to the law were made, highlighting the potential breach of human rights.
